Affidavits of Heirship and Intestate Succession

The course begins by discussing affidavits of heirship in general and how they are used to determine a deceased’s intestate heirs. We walk step by step through the Texas statutory form of affidavit and discuss the various provisions and their importance. We then turn to the laws of intestate succession. We first discuss the distinction between community and separate property and then apply the laws of intestate succession to various scenarios. We highlight the change in the intestacy laws since September 1993 and discuss and distinguish between intestate succession when dying married as opposed to dying unmarried. The course ends with general summary regarding affidavits of heirship and their purpose and allows a brief time for questions and answers.
