The course begins by discussing the use of a Marital History Questionnaire
and its importance. We explore when a spouse’s signature will be required to convey or encumber property and the concept of homestead property in Texas. We discuss common law marriage and the distinction between community and separate property (with specific examples), and how that affects title company requirements. We will then walk step by step through numerous examples of different marital situations involving the community, separate, and homestead property. We also discuss the unique Texas concept of owelty and owlety liens. The course ends with a general summary and allows time for a question-and-answer session.
